The rural land allocation limit for plain communes is 400m2; mountainous and island communes are 1,000m2. The above limits do not apply to cases of land allocation for individuals through auctions of land use rights, land allocation for resettlement; housing development projects according to approved planning.

Regarding the limit of residential land recognition for households and individuals: In case the land plot was formed before December 18, 1980, the limit of residential land recognition is determined by 5 times the land allocation limit mentioned above (but not exceeding the area of ​​the land plot). In case the land plot was formed from December 18, 1980 to before October 15, 1993, the limit of residential land recognition is determined as follows: Wards in 2 cities: Nha Trang, Cam Ranh and Ninh Hoa town 300m2; towns in Dien Khanh, Van Ninh, Cam Lam districts 360m2; towns in Khanh Son, Khanh Vinh districts 400m2; communes in Khanh Son, Khanh Vinh districts and island communes 500m2; remaining communes 400m2.

The limit of unused land allocation for individuals to put into use according to the planning for agricultural, forestry, aquaculture and salt production is as follows: Land for growing perennial crops, aquaculture and salt production land shall not exceed 2 hectares for each type of land; land for growing perennial crops shall not exceed 10 hectares for communes, wards and towns in the plains, and shall not exceed 30 hectares for communes, wards and towns in mountainous areas; land for growing protective forests and production forests shall not exceed 30 hectares for each type of land...

Decision No. 28 takes effect from October 31, 2024, replacing Decision No. 28 dated December 27, 2022 of the Provincial People's Committee promulgating regulations on land allocation limits; limits on recognition of land use rights for households and individuals; conditions for land division and consolidation according to each type of land and the minimum area for land division for each type of land in the province.
